Several residents on Aug. 5 urged the City Council to enforce a recorded 17-foot height limit in the Broadmoor supplemental covenants, conditions and restrictions (CC&Rs) that affect structures and vegetation along Calle De La Carta and adjacent properties.
Public commenters said the city previously required concessions and a recorded restriction as part of Broadmoor’s approval, that the homeowner association has not abated violations, and that council directions from prior meetings have not been implemented. Speakers asked the council to use its authority under the CC&Rs and the development approvals to require immediate remediation for remaining violations. Several residents described a long history of correspondence and asked the city to act directly rather than extend temporary compliance windows.
The mayor and city attorney said the matter is the subject of ongoing proceedings and that a continued public hearing on the dispute is scheduled for mid‑September. The city attorney cautioned that Brown Act and other procedural rules limit what councilmembers may discuss in public while the issue is pending. Councilmembers said they have received extensive written material and that staff will return with updates on the enforcement process at the scheduled hearing.
