The City Commission on July 28 approved a planning commission recommendation to amend the joint zoning ordinance to add language allowing property owners or applicants to sign a limited power of attorney to authorize a representative (such as an engineer) to attend public hearings in their stead.
Planning staff said the change codifies a longstanding practice in many Kentucky localities in which engineers or other authorized representatives appear on behalf of developers at planning commission hearings when the property owner cannot attend. The amendment clarifies that both the property owner and the applicant must attend or may sign the limited power of attorney as specified on an attached exhibit.
Commissioners discussed the amendment and then took a roll-call vote. The chair called the roll and recorded affirmative votes from Commissioner Caudill, Commissioner Pete, Mayor Atkins and Commissioner Holland. The ordinance language will be prepared for the next meeting to reflect the approved change.
Planning staff said the amendment is intended to provide clear direction and formalize a procedure that has been practiced in the past.
