Tippecanoe County commissioners handled several right‑of‑way and property items Aug. 18, including payments for a highway acquisition, two separate vacation ordinances and an extension of a temporary right‑of‑entry agreement.
The board approved a warranty deed purchase for Parcel 20 on the Canyon Road (500 East) reconstruction project: a warranty deed payment of $182,050 to Irving Materials and a partial temporary easement payment of $750. "We approve the warranty deed for a $182,050 and the temporary highway easement grant for $750 as presented," a commissioner moved; the board voted in favor.
On zoning and right‑of‑way matters, the board first considered Ordinance 2025‑25‑CM, which vacates a platted utility and drainage easement for two adjacent parcels. Petitioner Tony Harteback, president of Harteback Development, told the board the easement is unnecessary and that surveyor review and utility sign‑offs are on file. The ordinance passed 3‑0 on first reading, the board suspended rules and approved it on second and final reading the same day.
The board also heard Ordinance 2025‑32‑CM, a petition to vacate a public way along County Road 100 West north of Round Table Road related to the Research Village Phase 3 development by BC West Lafayette Land Holdings LLC. Ryan Munnon, attorney with RTS Law representing the petitioner, said the northern portion of 100 West is no longer needed because Round Table Drive and the Yeager extension provide alternate access. The county recorded first reading and set a public hearing for Sept. 2 to consider second reading and public comment; the ordinance passed first reading 3‑0.
Separately, the board approved an addendum extending a temporary right‑of‑entry agreement that allows the owner of the former YWCA property to access the county parking lot at Sixth Street for renovation work; the extension runs through Sept. 30, 2025.
Votes at a glance: warranty deed and temporary easement approved (motion passed); Ordinance 2025‑25‑CM approved on first and second/final reading (3‑0); Ordinance 2025‑32‑CM approved on first reading (3‑0); temporary right‑of‑entry addendum approved.
Background: staff said notices and survey documentation were provided where required and that adjacent landowner notices were not necessary when petitioners are the adjacent owners. The northern portion of the 100 West right‑of‑way may become county property following a related disannexation and vacating steps described by petitioner counsel.
