Board moves 10 voter-death challenges to evidentiary hearing on Sept. 4
Summary
The Board found probable cause to proceed to full evidentiary hearings on 10 voter challenges alleging registered voters are deceased; staff will notify affected voters, challengers and party chairs and hold hearings Sept. 4.
The Buncombe County Board of Elections voted to move 10 voter-challenge forms alleging the challenged registrants are deceased to a full evidentiary hearing on Sept. 4.
Staff said the office had received 10 challenges alleging the individuals on the challenged records were deceased; the forms and supporting documents (including death certificates where available) were in the packet for the Board’s review. The Board’s role at the meeting was to determine whether the forms were properly filed and whether there was probable cause to proceed to a formal hearing.
Staff described the notification and hearing process
Staff explained that if the Board determined probable cause, the office must notify the challenged registrants (or their representatives), the challenger and party chairs and schedule an evidentiary hearing. Staff recommended Sept. 4 as the hearing date. The Board voted to move forward and staff said notifications would go out the following morning.

Staff will send formal notices to the challenged registrants at the addresses on file and to the challenger and party chairs; the Board will hear the challenges at the September meeting and will consider evidence and testimony at that time.
