Speakers described a long history of city direction, filed declarations and legal records that, they said, show Broadmoor accepted a 17‑foot height limit for trees and landscaping as a condition of approval. Reva Buck and Paul LeFlore told council Broadmoor has abated only a small fraction of documented violations (6 of 42, according to speakers) despite council directives and an enforcement pause intended to resolve the issue directly with the developer. They urged the council to require abatement of remaining violations when the developer’s grace period ends on Sept. 16.
The speakers said the tree‑height requirement was recorded in Broadmoor’s supplemental CC&Rs and was a material condition tied to land, slope work and waived requirements that enabled the development. They accused the developer of using HOA procedures and threats of litigation to delay compliance and asked the council to uphold its prior determinations rather than allow continued noncompliance.
City response: Council acknowledged the lengthy record and confirmed staff has those documents on file. No formal action was taken at the Aug. 19 meeting; councilmembers asked staff to continue enforcement efforts and to report back to the council on any legal or procedural steps necessary to abate remaining violations.
