Council approves multiple land-use and code amendments, annexation and cemetery policy

Saratoga Springs City Council members on Tuesday night approved a set of land-use and municipal-code changes, adopted an intent-to-annex resolution for a residential subdivision and set interim cemetery policies for the new city cemetery.

The council took votes on multiple agenda items (motions listed below). Most measures passed unanimously.

Why it matters: The package of approvals touches development rules (architectural standards, outdoor seating parking, drive-through buffering and grading buffers) that will affect how commercial and residential projects are designed and permitted. The cemetery action sets in place a temporary operating policy and fees for the new municipal cemetery — a direct service that residents raised during public comment.

What the council approved (summary of formal actions taken): - Business Item 1, Lease agreement (Sensei Wave conduit/franchise agreement): Motion approved (motion adopted, outcome: approved unanimously). Staff said the agreement allows the franchisee to use existing conduit to reach the Viviano development and expand later.

- Business Item 2, Intent to annex North Lake Meadows 2: Motion to initiate annexation and begin the 30-day notice period approved unanimously. Staff noted zoning would be R-1-9 (single-family on 9,000 sq. ft. lots) to match adjacent Lake Meadows 1.

- Business Item 4, Amendments to Title 19 (architectural/site standards): Council approved a broad code amendment updating commercial and industrial architectural standards, adding 3-D renderings and material/color rules, clarifying multifamily standards and creating articulation requirements for buildings 20,000 sq. ft. and larger. The council adopted an amendment to keep current gutter color rules (do not allow accent gutter colors by default) and required awnings/covered entry elements with a suggested 5-foot depth; motion passed unanimously.

- Business Item 5, Outdoor seating parking amendment: The council adopted an amendment to Title 19 that requires one additional parking space per four outdoor seats when an establishment provides 12 or more outdoor seats. Motion passed unanimously.

- Business Item 6, Amendments to Title 19 (off-street parking / grading buffer and drive-through restrictions): The council approved code language that includes a 20-foot setback for drive-through lanes adjacent to residential development, limits speaker box operation between non-residential and residential areas (proposed hours restriction noted), and requires additional grading/buffer requirements for non-residential projects adjacent to residential uses; motion passed unanimously.

- Business Item (Title IX) — Animals code amendments: The council approved changes moving many animal-related violations from misdemeanors to administrative enforcement, set animal limits by residential lot (not unit), clarified notification for stray animals and added sanitation/manure provisions; motion passed unanimously.

- Business Item 7, Cemetery policy and fee direction: After public comment and staff presentation, the council adopted Option 1 (no routine Saturday burials for an initial period) with a process to allow exceptions approved administratively by the sexton for limited, documented circumstances. The council also directed staff to keep a Saturday surcharge in the fee schedule equal to two times the standard rate if the sexton approves a Saturday service; council asked staff to return with code language and to revisit the policy as needed. Motion passed unanimously.
