Planning Commission approves 2.2-foot encroachment into 20-foot setback for Nikiski Village building

NIKISKI — The Kenai Peninsula Borough Planning Commission on Aug. 11 approved a building setback encroachment permit allowing an existing commercial structure in Nikiski Village to remain approximately 2.2 feet within a 20-foot street setback.
Staff presented KPB file 2025-106, which describes an as-built condition where a roughly 2.2-foot by 28-foot section of the northeasterly side of the west segment of an aerial-shaped commercial structure encroaches into the 20-foot setback adjacent to Kenai Spur Highway. The structure dates to about 1970 and predates the plat that established the 20-foot setback in 1976.
Staff recommended approval, citing a set of findings (findings 4, 5, 8–11 and 14 among others) that support the applicable standards for an encroachment permit. The commission moved, seconded and voted to adopt the planning commission resolution granting the building setback encroachment permit subject to the conditions laid out in the staff report.
A person present confirmed the small food-trailer-style restaurant within the structure remains in place. The motion carried on a roll-call vote with all voting commissioners recorded as “yes.” The approved permit allows the structure to remain as shown on the 2025 as-built survey; staff cited the standards and findings used to justify the approval.
