Erie council hears repository-sale request for 1047 East Fifth Street; vote deferred

Brian Burks told the Erie City Council on Aug. 20 that he wants the city to approve a repository sale for the lot at 1047 East Fifth Street so he can expand the property beside his house. The council did not vote on the request during the meeting and said the clerk’s office will contact Burks before the item returns for a vote at the next meeting.
Burks said the lot is beside the house he owns and that, when he purchased his home, the realtor told him the lot was part of the property. He said he paid taxes on the parcel for one year and that he began the repository-sale process before the COVID-19 pandemic but encountered a delay. “When I bought the house, the realtor told me that that was part of the property. So from the beginning, I always thought it was mine,” Burks said.
Burks said he has removed significant trash from the lot using a rented vehicle and a junkyard, but that some items, including tires and a television, remained because of disposal restrictions. When asked whether he had code violations within the last three years, Burks said, “Not that I know of.”
Council President Witherspoon (opening the repository-sales portion of the meeting) told Burks the council would not vote that night and that the clerk’s office would contact him; council members recorded no formal action on the item at the Aug. 20 meeting.
