Council introduces ordinance to vacate Knollwood drainage easement; public hearing set for Nov. 3

City staff introduced an ordinance on Oct. 20 to vacate a recorded drainage easement associated with the Knollwood Farms detention pond as part of the Kingsbridge development. City staff explained the statutory process required under Indiana law: the vacation request first receives a recommendation from the Board of Works and then comes to City Council for ordinance introduction followed by a public hearing.
Staff said the existing pipe outlet was placed to cross a farm field and outlet to Brewer Ditch; with the Kingsbridge development and planned park improvements the recorded easement conflicts with new improvements. The proposed process will vacate the recorded easement and, at the same time, record a new easement and install replacement infrastructure so the detention pond continues to function as designed.
The council noted the Board of Works had given a favorable recommendation and set a public hearing on the easement vacation for Nov. 3, when council action will be taken. David Marks (Kingsbridge developer) attended; staff offered to answer engineering or logistics questions at subsequent meetings.
Why it matters: Vacation and re‑recording of drainage easements change legal maintenance responsibilities and stormwater routing. The council scheduled a public hearing to allow residents and interested parties to review the replacement easement and engineering plans before any final action.
