County authorizes eminent domain to acquire land on Chandler Road for roadway project

Commissioner Bowles moved the authorization; Commissioner Covey seconded. The court approved the motion 4-0. County staff said the property is required for construction of proposed roadway improvements on Chandler Road and is located in Hutto. The authorization allows county staff to use the county's eminent-domain authority to acquire the necessary rights if negotiations with the property owner do not result in a negotiated sale.
The court record shows the motion authorized acquisition for construction purposes; staff said valuation and closing details will be developed through the county's standard appraisal and acquisition process and that any condemnation action would be coordinated with general counsel and outside counsel as required.
Commissioners did not set a sale price in open session; staff noted that subsequent steps will include appraisal, title work and negotiations with Fusil Holdings LLC, and that any litigation or settlement would be brought to the court for approval.
