Warr Acres planning commission recommends council approve home daycare at 5929 Northwest 58

The Warr Acres Planning Commission voted unanimously Oct. 14 to recommend the City Council approve a use-on-review application for a home daycare at 5929 Northwest 58, operated by Christian and Isela Flores, with the condition that the operator meet state Department of Human Services (DHS) requirements and local ordinance limits.

City staff told the commission the property is in an R‑1 residential zoning district and the application meets the city’s criteria for a home daycare as a use on review. The staff presentation noted the city ordinance limits the number of children in a daycare home to seven or fewer; if children are 2½ years old or younger, the number must not exceed five. Staff said the applicant understands those limits and must comply with DHS rules.

Isela Flores, the applicant, said she is a stay-at-home mother with a 2‑year‑old daughter and that she plans weekday hours “about 7:30 a.m. to 5:00 p.m.” She said she intends to accept children aged about 1 to 5 years and that, while state rules allow up to seven children in some circumstances, “I really don't wanna have more than 5,” calling five her personal maximum. Flores described a drop-off procedure she said follows DHS guidance: parents will park on the north side near the sidewalk, bring children inside and sign them in and out.

City staff identified one potential traffic consideration: 50th Eighth Street is adjacent to the Capps Middle School bus loop, and overlapping school drop-off and daycare drop-off times could create vehicle congestion. Flores said she intends to include a parent handbook that limits the length of drop-off/pickup to keep cars from waiting on the street.

Commissioners conducted a roll-call recommendation for the council. Commissioners Plumtree, Schiff, Davis, Clifton and Johnson each voted yes; the motion to recommend approval passed unanimously. The commission noted its role is advisory and the City Council will hold the final hearing at a subsequent meeting.

The application file lists the operator as Christian and Isela Flores at 5929 Northwest 58; the applicant provided a home address in the hearing record. The commission’s recommendation is conditioned on the applicant meeting state DHS licensing recommendations and any stipulations the council or staff add during the council hearing.
