Council hears status update on community septic loan program; DEM application not yet submitted

The town solicitor and staff said they had reached out to the infrastructure bank’s legal counsel to determine requirements for the application. During the meeting staff clarified that the application to DEM — including copies of prior actions and exemplars — had not been submitted. One staff member said the community previously did not adopt an ordinance in the town for a similar program, but the transcript records uncertainty about whether an ordinance is mandatory in this case.
Councilors asked staff to confirm whether an ordinance is required. If DEM requires a local ordinance adopting the loan program, the council was told it would need to draft an ordinance, hold a public hearing and adopt it before the application could be finalized and sent to DEM. The council did not take formal action on the item but directed staff to follow up and report back.
