Trustee pushes expanded legal counsel access; board debates requiring searchable PDFs for materials

A trustee-led resolution to expand the list of legal counsel the Hartland Consolidated Schools Board of Education may consult and to broaden which board members can request legal advice prompted an extended discussion at the July 21 meeting. The board also discussed a separate staff- and trustee-backed proposal to require that documents shared with the board and posted to the public be provided in searchable PDF format.
Trustee Scott presented the draft resolution on expanding legal counsel access and said the intent was to give trustees more than one firm or viewpoint to consult and to make it easier for trustees to obtain legal opinions on matters that directly affect the district. "I think each and every one of us deserves the ability, the right to get that legal advice on behalf of the welfare of the district," he said during discussion.
Supporters said multiple firms allow access to distinct specializations (for example, board-member advice versus bond/policy counsel) and reduce the risk of relying on a single source. Opponents expressed concern about cost control, duplication of effort, and the proper gatekeeping role of the board president and superintendent. Trustee Cindy Shaw said she preferred that requests for legal advice continue to be coordinated through existing channels to avoid potential confusion.
Superintendent Matt Hughes said the district has historically handled requests by routing them through the board president and the superintendent and that legal opinions are typically produced for the board and are not public records. "Legal opinions are not... available for the public," he said in the meeting record while explaining customary practice for distributing attorney guidance to the board.
Trustees agreed the matter should be discussed in policy committee and that clearer written policy is needed; a number of trustees asked the administration and policy committee to bring proposed language back to the full board. Several trustees said they had at times encountered limits when attempting to obtain legal guidance and that written procedures would clarify who may contact counsel, under what circumstances, and what approvals or reporting are required.
On the separate document-format discussion, Trustee Scott proposed a resolution requiring that documents prepared by administrators and shared with the board or public be provided in searchable PDF format to improve accessibility and usability for trustees and members of the public who rely on text-search or assistive technologies. District staff told the board the information technology team will audit the website and begin work on accessibility; staff also said some materials (for example, certain scanned images) may present conversion challenges and that, where searchable PDFs are infeasible, staff would provide a written explanation and, where feasible, text-based alternatives.
No final votes were taken on either the legal-counsel resolution or the searchable-PDF resolution at this meeting; the chair confirmed both items would return as action items at an upcoming meeting after committee review and staff follow-up.
