Julie, the zoning administrator, told the board that outdoor patio seating in the B‑3 zoning district is a conditional use and that the proposed patio sits adjacent to the building and is separated from parking by a fence. She said the location is far enough from the right of way to comply with the city’s development guidelines.
No members of the public appeared to speak, and staff reported no written communications on the matter. The board made the required findings for a conditional use — compliance with applicable regulations, no expected substantial injury to neighboring property values, and adequate parking and utilities — and voted to authorize the chair to sign a resolution granting the conditional use. Dan Colson moved to grant the conditional use; the motion was seconded and approved. The resolution will be prepared within 45 days and may be appealed to district court within 30 days after the resolution is filed.
