A Flower Mound resident used the council's public comment period to describe what he said was excessive cement dust coming from a temporary batching plant at the Towne Lake construction site and urged the town to investigate and halt operations until the problem was resolved.
Fred Vincent said construction runoff previously affected local ponds and livestock and described a visible plume he identified as “flash cement dust.” He urged the town to red‑tag the operation and called for water and soil testing for cleanup. “I think this is out of control,” Vincent said during public comment.
Town staff and the developer's representative responded during the meeting. A town inspector (Tommy) said code officers and environmental staff responded promptly and that their inspections did not indicate insufficient dust suppression. Mike Boswell, representing Toll Brothers, said the batching plant is temporary and permitted and that Toll Brothers was monitoring community concerns. Boswell provided regulatory identifiers on the record, saying the plant is permitted under a TCEQ package application and citing permit number 5337L001 and RN 3738788; he said the site would demobilize after completing scheduled pours.
Boswell also disputed assertions that fly ash was being used at the plant and told council, “we are in full compliance with the town and TCEQ standards.” Town staff said they would continue oversight; no enforcement action was announced at the meeting.
The council did not vote on enforcement or operational restrictions at the meeting; staff said they had inspected the plant and would continue monitoring and follow up with Toll Brothers.
