Commission approves 30-year time extension for proposed Apex Energy battery project

The Imperial County Planning Commission voted July 23, 2025 to approve an amendment to Conditional Use Permit 23‑25 to extend the permit’s time limit from 15 years to 30 years for a proposed 100‑megawatt battery energy storage system at 1884 Drew Road in Sealy.
Planner Heraldo Kettle explained the amendment request from Apex Energy Solutions LLC as a change to General Condition G10 to reflect project life‑cycle and financing needs. He said the previously approved CUP authorized construction and operation of a 100 MW battery energy storage facility and that, if approved, the amendment would leave all original conditions of approval in place.
Heraldo told commissioners that staff recommended finding the amendment exempt from environmental review under the standards cited in the project report (staff referenced government‑code and CEQA screening provisions as noted in the file) and recommended adoption of the attached resolution with supporting findings. Applicant representative Ramon Gonzales told the commission he had reviewed the project materials and had no questions.
A commissioner moved to recommend approval of the amendment as recommended by staff and the commission voted to approve the amendment. Planning staff advised that anyone wishing to appeal the commission’s decision may file an appeal in writing with the Planning and Development Services Department.
