West Fargo panel recommends conditional-use permit for 1,344-square-foot accessory building in McMahon Estates

The West Fargo Planning and Zoning Commission voted Sept. 9 to recommend approval of a conditional-use permit allowing a 1,344-square-foot accessory structure at 21450 First Avenue East (Lot 2, Block 3, McMahon Estates Third Edition) in an R-1E zoning district.
Lisa, a city planner, told the commission the applicant submitted a site plan showing a 1,344-square-foot rear-yard accessory structure and that staff found the application consistent with the city’s plans and ordinances. "Staff recommends that the city approve the conditional use permit application on the basis. It is consistent with city plans and ordinances subject to the following," Lisa said, listing construction- and agreement-related conditions.
Under staff recommendations, the accessory building must be constructed of the same color and materials as the primary residence and a signed conditional-use permit agreement must be received by the city. Lisa said notices were sent to property owners within 350 feet and that staff received one call requesting more information; no concerns were reported from that caller.
Commission discussion was limited and no public comments were offered during the public hearing. A motion to recommend approval with two conditions passed on a roll-call vote. Commissioners voting yes were Commissioner Schwan, Commissioner Amann, Commissioner Wery, Commissioner Fornace, Vice Chair Thorstad and Commissioner Gust; the motion carried.
The commission’s recommendation will be forwarded to the City Commission in ordinance form for final action. The applicant referenced in the staff presentation was Brandvold; Lisa noted an earlier, nearby approval earlier this year for an 1,800-square-foot accessory structure in McMahon Second Subdivision and said previously approved accessory structures in the McMahon Estates area have ranged from about 1,600 to 2,200 square feet.
No additional conditions or changes to the proposed structure’s size were recorded during the meeting.
