Municipal Services Committee approves three occupancy permits and minutes on Aug. 25

The Municipal Services Committee on Aug. 25 approved minutes from its Aug. 11 meeting and three permits allowing temporary or permanent use of city right-of-way for local businesses and a construction dumpster. All four motions passed by voice vote, recorded as 3-0.

Deputy Director Neuberger of the Department of Public Works told the committee that the department reviewed each request and recommended approval. “DPW has reviewed this request. It was approved administratively for the first 35 days…staff supports the request,” Neuberger said regarding the construction dumpster permit for Superior Street. On the Vault 202 Brewery and Taphouse application, Neuberger said DPW found the proposal in compliance with the sidewalk cafe policy and noted the applicant demonstrated the required eight-foot clearance on the sidewalk. For the permanent occupancy permit tied to the basement beneath a portion of Johnston Street Alley, Neuberger said an investigation found that a portion of the alley “was never dedicated as public right of way. It’s still private property,” and that the right-of-way dedication is slated for a forthcoming City Plan Commission agenda.

The committee first approved agenda item 20-51014, the minutes from the Aug. 11 meeting, by unanimous voice vote. The committee then approved item 25-1011, a long-term temporary occupancy permit allowing a construction dump dumpster on Superior Street through Dec. 31, 2025; staff said the permit extends an initial 35-day administrative approval to support refurbishing work at the Copperleaf Hotel. The committee approved item 25-1012, a long-term temporary street occupancy permit for Vault 202 Brewery and Taphouse at 202 West College Avenue to place tables and chairs in the College Avenue amenity strip; staff confirmed compliance with the sidewalk cafe policy and the eight-foot pedestrian clearance. Finally, the committee approved item 25-1013, a permanent occupancy permit for the basement of the building at 202 West College Avenue that extends into the Johnston Street Alley right-of-way; DPW and Community Development are processing a formal dedication of that portion of the alley to public right-of-way, which Neuberger said will appear on a City Plan Commission agenda.

Each motion was moved and seconded on the record and passed by voice vote with no recorded no votes or abstentions. The meeting had no public hearings or appearances and adjourned shortly after the votes.

City staff and the committee identified next steps for the permanent occupancy matter: the right-of-way dedication process will proceed through the City Plan Commission before final administrative adjustments for the occupancy permit become effective.
