The hearing examiner for the Metropolitan Development Commission on Aug. 14 approved the petition to vacate a portion of Evanston Avenue so the Catholic Archdiocese of Indianapolis Properties, Inc., and Sce (?) (petition identified as Shetard High School in the record) can assemble contiguous property for school use.
The petitioner’s representative, Brian Tuohy, identified himself and described that the Archdiocese already owned parcels on both sides of Evanston Avenue from Northgate Street to 50 Eighth Street and sought the vacation to permit installation of tennis courts and related facilities. Staff reviewed the appraisal and assessment of benefits and said it supported the figures presented.
The hearing examiner adopted the final assessment of benefits in petition 2025 CVC 829 in the amount of $8,700 and required the petitioner to pay the appraiser’s fee of $1,000. The decision included the usual reservation of public-utility interests under state vacation law (referenced in the hearing record as IC 36-7-3-16).
Staff told the examiner it had reviewed the appraisal and agreed with the auditor’s findings. With that record, the examiner said he found the vacation “in the public interest,” confirmed and ratified declaratory resolution 2025 CVC 829, and ordered the assessment and appraiser fee as noted.
The order will be placed in the Metropolitan Development Commission record; the hearing examiner’s decision is final unless an appeal is filed under MDC rules of procedure within the time allowed by the commission’s rules.
