Planning commission approves Big Sur lot-line adjustment to separate tenants-in-common ownership

The Monterey County Planning Commission on Aug. 13 approved a coastal development permit to adjust boundaries among four existing parcels on Highway 1 in Big Sur so each tenant-in-common owner can hold separate parcels for estate planning and financing.
County planner Joseph Valmeda said the proposed lot-line adjustment rearranges four legal lots of record — approximately 5 acres, 5.1 acres, 11.1 acres and 10.7 acres — into four adjusted parcels of about 5 acres, 10.2 acres, 9.8 acres and 6.9 acres. No new parcels will be created; all adjusted parcels meet the watershed and scenic conservation zoning district’s minimum one-acre requirement. Valmeda said the adjustment will bring existing development into conformance with required setbacks and site coverage for the WSC zoning district.
Attorney Laura Lawrence, representing the applicants, told commissioners the owners acquired the property as tenants in common in the 1970s and that the adjustment will permit separate ownership for estate-planning and financing purposes. Lawrence said the applicants accept the five conditions of approval.
Why this matters: The lot-line adjustment clarifies ownership for four residents and restricts future development: although the parcels are smaller than the WSC density standard of 40 acres per dwelling, the modified parcel sizes prevent construction of an additional single-family dwelling on any of the lots under current zoning rules.
Action: Commissioner Hartsell moved to support staff’s recommendation as amended; Commissioner Shaw seconded. The motion passed unanimously.
Background: Staff recommended the commission find the project categorically exempt under CEQA Guidelines §15305 and accepted an errata correction to the resolution. The Big Sur Land Use Advisory Committee reviewed the proposal and voted unanimously to support it; no public comments were recorded at the hearing.
Next steps: The county will record the lot-line adjustment and applicants will proceed with any required estate-planning and financing actions outside of the county land-use entitlement.
