The applicant, who identified himself as Donnie Galan and said he is the general contractor for the project, told the panel he agreed with staff recommendations and was available to answer questions. "I am the general contractor on behalf of the investor for the property... we construct by the plans, and that's the only way that we construct," Galan said, adding that required residential proximity slope (RPS) issues would be reviewed in building plan review rather than in this variance hearing.
Panel members said the application demonstrated an unnecessary hardship tied to the property's physical characteristics. Roger Sashington moved to grant the 4-foot variance; Andy Finney seconded. Mary Williams called the roll and the motion passed 5-0. The board attached the standard condition that the applicant must comply with the most recent version of all submitted plans.

Panel members confirmed that RPS issues were not part of this variance; if RPS were at issue, a separate application or review would be required.
