City planning staff briefed the Mayor and City Council Oct. 21 on a rezoning application (Tract XM 2025‑021912) for roughly 22 acres of a 93‑acre parcel off Duluth Highway (Day Road rezoning). The presentation outlined the parcel’s split current zoning (Commercial General and Neighborhood Mixed Use) and described the applicant’s request to shift the base zoning line so most of the property would be neighborhood mixed use.
Staff explained the legal standard for a piecemeal change to the zoning map: the council must find a change or mistake in the zoning since the last comprehensive rezoning (a “mistake” argument was the applicant’s approach). The planning commission held a public review meeting, found the applicant’s “mistake” argument persuasive and forwarded a positive recommendation to council. Staff noted that about one‑third of the subject area is floodplain and would not be developable; developable land lies to the north and south of the floodplain.
Staff also said public comment at the planning‑commission meeting showed neighborhood concern about development itself (loss of an adjacent farm), rather than strictly the rezoning standard. The council was briefed on process and reminded that the public hearing on the rezoning will take place at the council’s next meeting; the legal test and public testimony will be considered at that hearing. No action was taken on Oct. 21.
