Ashley Leonard, assistant city attorney, told the committee that the leases include termination-for-default provisions under article 12 (termination/default) rather than termination for convenience; typical defaults would include nonpayment of rent or breach of other lease obligations. Several members said they supported multi-year terms because concessionaires and event operators make substantial capital investments — docks, wiring and other site infrastructure — and require longer leases to amortize those costs.
One member moved and received a second to recommend the items favorably to the full council; the committee approved the recommendation by voice vote. Committee members asked staff to ensure that lease enforcement and default remedies are clear and noted the importance of giving vendors assurance to invest in site infrastructure.
