Minot City Council members voted unanimously Monday, July 21, to meet in executive session to consult with the city attorney and provide negotiating instructions regarding a pending eminent domain case involving Parkview MHP LLC.
The council made the motion to discuss agenda item No. 3 in executive session during a special meeting called for July 21. The presiding city official cited the legal authority on the record as North Dakota Century Code and closed that portion of the meeting so council members could consult with counsel and discuss negotiating strategy.
The vote to move into executive session was “moved and seconded,” and the presiding official said, “The motion passed unanimously.” Roll call earlier in the meeting recorded Council members Blesham, Fuller, Janser, Olsen, Pittner and Samuelson as present.
City staff said the executive session began at 4:48 p.m.; the council adjourned the closed session at 5:18 p.m. and returned to the dais to reconvene the open portion of the meeting at approximately 5:20 p.m. After returning to open session, the presiding official noted there was “no potential action to take, following executive session.”
The council also approved a motion to adjourn the special meeting after reconvening; that motion was moved and seconded and carried by voice vote.
No formal decisions or final actions on the eminent domain matter were announced in open session during the meeting. The council’s comments on the record limited discussion during the closed portion to the stated purpose of consulting with counsel and providing negotiating instructions to attorneys and negotiators.
