Faribault policy committee sends multiple MSBA policy updates to school board; staff development and student publications tabled

The Faribault Public School District policy committee on Aug. 5 voted to forward a slate of MSBA-recommended policy revisions to the school board, while tabling two items for further review.

Most of the committee’s actions were votes to send updated mandatory and nonmandatory policies — including harassment and violence (Policy 4.13), mandated reporting (4.14), drug-free workplace/school (4.18), weapons (5.01), attendance (5.03), student records/privacy (5.15), student medication and telehealth (5.16), overdose medication (516.5), internet acceptable use (5.24), school meals (5.34), literacy/Read Act (6.21), transportation policies (7.07 and 7.09), disposal of obsolete equipment (8.02) and crisis management (8.06) — to the full school board for consideration.

The committee’s packet and in-meeting discussion indicated most changes reflect statutory updates or clerical language recommended by the Minnesota School Boards Association (MSBA) or state statute. Several policies were described in the meeting as mandatory and revised to align with Minnesota law and federal regulations where noted.

Why it matters: Many of the forwarded policies address mandatory compliance items affecting student safety, privacy, attendance, health and transportation. The two items the committee tabled drew extended discussion and will return with more information: Policy 4.25 (staff development) was tabled so the committee can get an explanation from MSBA on why appointment language was changed from the school board to administration; Policy 5.12 (school-sponsored student publications and activities) was tabled pending review by legal counsel to clarify the implications for editorial control and First Amendment concerns.

Key details and votes - The committee voted to send Policy 4.13 (Harassment and Violence) to the school board. The revision updates the definition of “disability” to reflect Minnesota law and reiterates that Policy 4.13 is mandatory.

- The committee voted to send Policy 4.14 (Mandated Reporting of Child Neglect or Physical or Sexual Abuse) to the board; the update reflects statutory number/language changes.

- The committee voted to send Policy 4.18 (Drug-Free Workplace/Drug-Free School). Staff noted the revision references tribal medical cannabis and participant protections recommended by MSBA.

- The committee voted to send Policy 4.25 (Staff Development) to the board but tabled final action on the committee’s internal amendment request. Several members questioned MSBA’s removal of “school board” appointment language and debated whether appointment authority should rest with the school board, administration, or both. A motion was passed to table further action on 4.25 until the committee’s September meeting so staff can obtain an explanation from MSBA and relevant statute citations.

- The committee voted to send Policy 5.01 (School Weapons) to the board. The update clarifies definitions of “dangerous weapon” and adds an active-shooter reporting element.

- The committee voted to send Policy 5.03 (Student Attendance) to the board. Staff said statutory changes to attendance/truancy practice will require additional implementation guidance; the district will coordinate a September meeting with Rice County Attorney Brian Mortensen to brief principals on enforcement changes.

- The committee discussed and then tabled Policy 5.12 (School-Sponsored Student Publications and Activities) for legal review. Committee members raised concerns about whether the MSBA changes reduce district supervisory authority over student newspapers and yearbooks and sought legal rationale for the revisions. The committee voted to bring the item back on Sept. 2 with additional legal input.

- The committee voted to send Policy 5.15 (Protection and Privacy of Pupil Records) to the board; staff said this update aligns parent contact, student health and census provisions with recent legislative changes and federal regulations (cited in the packet).

- The committee voted to send Policy 5.16 (Student Medication and Telehealth); meeting materials show the term “auto-injectors” was replaced with “delivery systems” in definitions and related language.

- The committee voted to send Policy 516.5 (Overdose Medication) to the board; the packet adds an allowance permitting another student (high school grades 9–12) to possess and administer an opioid antagonist to another high school student.

- The committee voted to send Policy 5.24 (Internet Acceptable Use and Safety); the revision removes cell phones from this policy to avoid conflict with the district’s separate standalone cellphone policy as required by Minnesota statute.

- The committee voted to send Policy 5.34 (School Meals); changes clarify what constitutes a free meal under updated guidance and allow students to purchase a second breakfast or lunch (the second meal is not free).

- The committee voted to send Policy 6.21 (Literacy and the Read Act), Policy 7.07 and 7.09 (Transportation of Public School Students), Policy 8.02 (Disposing of Obsolete Equipment and Materials) and Policy 8.06 (Crisis Management) to the board; most changes were described as clerical or statutory-alignment edits (for example, pluralizing “disabilities,” adding an anonymous threat reporting system reference, and authorizing disposal of surplus books to 501(c)(3) organizations or district families).

Discussion highlights - Staff development (4.25): Committee member Jamie proposed reinstating the school board’s appointment role alongside administration, citing a statute describing the board’s duty to superintend schools. Committee members requested MSBA’s rationale for removing board appointment language; the committee voted to table 4.25 until Sept. 2 pending MSBA input and statutory citations.

- Student publications (5.12): Several committee members expressed concern that the MSBA edits could limit the district’s ability to supervise student publications and protect students from harassment or hate speech. One committee member said the MSBA update had been “very poorly received by many districts across the state.” The committee voted to table 5.12 until legal counsel can provide guidance for the Sept. 2 meeting.

Implementation and next steps - Two items (4.25 and 5.12) are scheduled to return to the policy committee on Sept. 2, 2025 with additional information requested (MSBA rationale and legal review). Several other items were described as mandatory policy updates that will be transmitted to the full school board for approval.

- Staff said they will coordinate a principals’ briefing with Rice County Attorney Brian Mortensen in September to discuss statutory changes affecting attendance and truancy enforcement.
