Hayden planning commission approves conditional-use permit for Church of the Living Water

The City of Hayden Planning and Zoning Commission on July 21 approved a conditional-use permit allowing the Church of the Living Water Inc. to build a 7,500-square-foot religious facility on two parcels at 1202 and 1212 West Hayden Avenue.
The permit was approved with the staff-recommended conditions of approval as amended. The commission voted unanimously; Commissioners Erickson, Johnson, Morris and Chair Taylor each recorded “aye.”
The commission heard a presentation from applicant representative Connie Krueger of Stonehenge DNG and from the owner’s representative, Arthur Tormozov. Krueger told commissioners the church site is two parcels totaling 2.76 acres (0.87 and 1.89 acres), zoned single-family residential (R-1), and proposed as a conditional-use religious institution with a potential future accessory school use. Krueger said the project includes off-site dedications and that the church will pay impact fees, capitalization fees and building-permit fees: “All of the items that we are legally required to pay will be paid by the Church, similar to any other development.”
Staff member Donna summarized the city’s conditional-use standards under Hayden City Code Title 11 and noted the parcels’ future-land-use designation as mixed use. Donna said agencies that reviewed the proposal raised standard, site-specific requirements: Idaho Department of Water Resources asked the applicant to coordinate any new water uses; Northern Lakes Fire Protection flagged future road, driveway and fire-flow requirements; and Hayden Lake Irrigation District asked that water service be provided from West Hayden Avenue and that hydrant locations be confirmed with the fire district. The staff recommendation included conditions requiring lot consolidation into a single building envelope, required landscaping and buffers, right-of-way dedications and grant of easements for utilities and irrigation district access.
Connie Krueger described the proposed building program as an assembly area, three classrooms, a nursery, kitchen and support spaces. The site plan proposes ADA parking, 5-foot sidewalks around the building, circulation aisles sized from 24 to 30 feet, and 18-foot, full-cutoff light fixtures directed inward to meet the city’s minimum lighting uniformity. Buffers against adjacent residential uses include a 10-foot Type 1 buffer with evergreens and a 5-foot parking perimeter buffer for required parking islands. Krueger said the church will extend public and private utilities to the site at its cost and will provide a grease interceptor for the kitchen.
One member of the public, Ben Borovetz, spoke in favor of the proposal and described his personal support and his family’s desire to have the church in the community. Following public comment, commissioners deliberated, finding the proposal met the three standards for a conditional use in Title 11: consistency with the comprehensive plan and zoning, adequate existing or planned public services, and compatibility of design and operation with surrounding uses. Commissioner comments noted the site’s mixed-use context and off-peak traffic patterns for church activities.
The motion approved the conditional-use permit with the amended staff conditions, including: completion and recording of a lot consolidation prior to development on a single building envelope; compliance with Hayden City codes for landscaping, lighting, parking and stormwater at the time of site-development application; dedications of right-of-way and granting of easements (including an easement to Hayden Lake Irrigation District for future water main alignment); and coordination with Northern Lakes Fire Protection on hydrant placement and road standards. The approval runs with the land while the property remains a religious institution use.
The applicant may proceed to submit construction plans and building-permit applications; those plans will be reviewed for compliance with the conditions and agency requirements before a certificate of occupancy is issued.
