Irvine council votes 4–3 in closed session to prepare amicus brief in federal immigration case

City Attorney Jeff Melching told the council in open session that on the first two closed-session matters there was "no reportable action," but that on the second anticipated-litigation matter the council had provided direction to prepare an amicus brief for filing in Vasquez Perdomo v. Kristi Noem, as Secretary or acting head of the U.S. Department of Homeland Security. Melching said the proposed amicus brief will be brought back to the council for further review at a later meeting.
The city attorney reported the closed-session vote on that matter was 4 to 3, with Vice Mayor Mai, Council member Carol, and Council member Goh voting no. Melching did not provide the text of the motion in open session; he said only that the council had provided direction to prepare the brief.
The matter had been listed under the closed-session agenda as "anticipated litigation" pursuant to Government Code section 54956.9(d)(4). The council did not disclose a final brief tonight; it said the draft would return for public review before filing.
No public comment was taken during the closed session. The city attorney's report to the council in open session identified the case by name and noted that further review of the draft amicus brief will occur publicly before any filing.
