The Sweetwater County School District #1 Board of Trustees on Oct. 13 adopted a revision to Policy KD, the district rule governing public participation at board meetings, after trustees said the changes reflect legal advice and provide clearer pathways for confidential or personnel-related concerns.
Board chair Wright opened discussion by reading legal counsel’s guidance, saying the revision was prepared “at the advice of legal counsel” and “does not violate any court rulings regarding public comment or free speech.” He said the policy aims to preserve the public’s ability to address the board while pointing speakers to appropriate alternate pathways when privacy or due‑process issues apply.
The board emphasized the revision is intended to help route concerns to the right office—building administrators, human resources or the superintendent—so they can be handled promptly rather than left unresolved after public comment. Trustee Dr. Franks and other members said the change is intended to help the board act on legitimate appeals while protecting confidentiality when required by law.
Trustees discussed recent legal decisions and the practical difficulty of acting on personnel complaints raised in public. Trustee Gardner said that when a complaint reaches the board as an appeal it must be handled impartially and that prior public statements can limit a board member’s ability to participate. Trustee Sorensen and others said the change is designed to protect both the district’s legal exposure and the rights of individuals making complaints.
After discussion, Trustee Dr. Franks moved to approve Policy KD as presented; Trustee Wood seconded. The measure passed on a voice vote.
The policy revision drew sustained public attention at the meeting; several speakers had asked the board for clearer response timelines and for ways to address bullying and personnel concerns. Chair Wright and Superintendent Dr. Libby said the district will continue work on an infographic to show the chain of communication and the appeals process so members of the public know how to escalate unresolved issues.
A copy of the revised Policy KD will be posted with the board materials. Trustees said legal counsel will attend future meetings as the district establishes the new norms for public participation.
