Council adopts assessments for unpaid noxious-weed and diseased-tree abatements

The Cottage Grove City Council on Oct. 15 adopted a resolution placing unpaid special charges on the tax rolls for properties where the city contracted to remove tall grass, noxious weeds or diseased trees.
Brenda Malinowski, finance director, said the assessments follow city code and a statutory collection process. Staff noted that code enforcement issued 79 notices in 2025 and that the city contracted to abate conditions in three cases during 2025 and in three cases late in 2024; after contractor work, invoices were sent to property owners and remained unpaid.
Malinowski said the ordinance citations relied on in staff’s presentation included the city code sections on tall grass and on diseased trees; she also cited state statute authority for the assessment and certification process. After tonight’s adoption, property owners will receive a further notice with 30 days to pay before the charges are certified to be collected with property taxes.
Emily Schmitz, community development director, explained that the city treats diseased or dead trees differently depending on whether they create a public nuisance (for example, trees overhanging a sidewalk or right of way) and that city staff are mindful not to become the primary agency removing private trees except in unique circumstances where public impacts are demonstrated.
Councilmember Olson moved adoption of Resolution No. 2025-153 adopting unpaid service charges for abatement of noxious weeds, tall grass and diseased trees; Councilmember Claussen seconded and the motion carried by voice vote.
Staff said property owners will receive 30 days from the notice to pay the invoiced amount; if not paid the charge will be certified and collected with taxes.
