City narrows allowable uses for Lake Ridge city-owned parcels after resident input; second nearby rec-center site revised

Planning staff presented proposed plan-development controls for city-owned property in the 5300 block of Lake Ridge and described a related, withdrawn zoning item for a nearby England and Lake Ridge parcel originally considered for a recreation center.
Staff said the city purchased the 5300 block parcel and initially considered it for a community or heritage center, but public input discouraged that use. Because the property is currently zoned general retail under PD-2678, staff proposed a new PD that would limit allowable uses on the parcel. The presenter said state law changes from Senate Bill 8 40 mean the city cannot prohibit multifamily uses in every case where the base district allows retail or similar uses, so the PD approach and a deed restriction may be used to limit certain uses on the city-owned parcel. "The property is currently zoned general retail under PD 2 67 8. So we created a PD that would limit the number of uses allowed on that property," the presenter told commissioners.
Staff reported receiving letters opposing development that some writers described as "apartments," though staff said that concern likely stemmed from confusion with another pending case; staff emphasized that the Lake Ridge PD is not an apartment proposal. Development Review Committee recommended approval of staff’s PD recommendation for the city-owned Lake Ridge parcel.
Separately, staff said it withdrew the zoning case for a second parcel at England and Lake Ridge after citizen opposition to a proposed hybrid "built-to-rent" housing category that residents equated with apartments. Staff said the hybrid housing category will be removed and the item returned to a future agenda after revisions. Commissioners discussed deed restrictions as a way the city can further limit post-sale uses of city-owned property; staff said a deed restriction on a property sold to a private party could be an enforceable tool even where an ordinance alone would conflict with state law.
Commissioners also raised community needs: one commissioner representing the affected district said they were disappointed the city would not build a recreation center on the site and urged additional outreach and consideration of alternatives. Staff said they have engaged property owners and will continue comp-plan updates and community outreach through the coming months.
No formal commission vote was taken at the briefing; the PD for the city-owned Lake Ridge parcel was recommended by staff and will advance to public hearings and council consideration.
