Garner annexes 100.11 acres for Homestead at Bridal Farm after applicant invokes permit‑choice option

Garner — The Garner Town Council adopted an ordinance (20255350) on Aug. 5, 2025, annexing 100.11 acres for the Homestead at Bridal Farm project after the applicant elected to proceed under the state’s permit‑choice rules and declined a special‑use permit hearing.
Planning director Jeff Triesenberg told council the contiguous annexation petition (ANX‑24‑20) covers 100.11 acres in southeast Garner near South Garner High School and several established subdivisions. He said the zoning for the project was approved previously as CZMP‑23‑04 on Oct. 22, 2024.
Mark Frederick, attorney for the applicant with Parker Poe Adams & Bernstein, told council that, “under the permit choice rules, we are going to elect to follow the recently adopted rules regarding special‑use permits and the threshold required for a special‑use permit, which means this case… would not need a special‑use permit to be approved. So we’re going to elect to follow those rules.”
Earlier in the meeting, the council had voted unanimously to remove the special‑use permit item (SUP SB24005) for the project from the agenda after the applicant signaled the intent to proceed under permit choice. The motion to remove the SUP item was moved and seconded and carried on a roll‑call vote recorded as unanimous.
On the annexation ordinance, Mayor Pro Tem Mark Vance moved approval; Council member Matthews seconded. The roll‑call vote on ordinance 20255350 was Vance — aye; Dellinger — nay; Behringer — aye; Singleton — aye; Matthews — aye, carrying 4‑1.
Council member Dellinger explained his opposition, saying he opposed annexation partly because of zoning density (R‑8) and the lack of commercial parcels and expressed concern there were no commitments for affordable housing units in the plan. Other council members supporting annexation said the zoning and project details had been reviewed previously and that the annexation brings property into town control for development oversight.
The transcript records that the applicant filed the annexation application through Jesse Hardesty of McAdams, and that the annexation ordinance was ready for council adoption should they choose to proceed.
The annexation ordinance brings the 100.11‑acre parcel under the town’s jurisdiction; staff indicated that further project review and permitting will follow the town’s procedures and the applicant’s chosen permit path under state law.
