Warrick County drainage board denies culvert permit for Lot 20 in Castle Ridge subdivision

The Warrick County Drainage Board on Aug. 25 denied a request to install a culvert on Lot 20 of the Castle Ridge subdivision after a staff inspection found extensive fill, a covered manhole and what the inspector said was a narrowed drainage easement.
A county inspector described arriving at the site and finding what he estimated as a large quantity of fill placed on the lot, saying, "They'd hauled a huge amount of fill in to the lot. The lot laid low. They probably 20 feet of fill. They ran the fill over and filled the creek up." The inspector said he was unable to locate a manhole that should have been present and that the development had covered a street inlet that was part of the drainage system.
The inspector told the board that the creek channel is part of the legal drain system of Gardner Webb Ditch and that the drainage easement had been reduced from an 80-foot width on each side to roughly 5 feet within the subdivision.
"I couldn't find a manhole that was supposed to have been, already there. That was part of the drainage from a street, inlet on a cul de sac. They covered it up," the inspector said, adding that contractors had told him the pipe and ditch were needed only to provide access for a homeowner's planned swimming pool, and that the pool location on-site differed from where it had been represented to staff.
Board members moved to deny the culvert permit; the motion passed "Aye. Motion carries 3 0." The board did not adopt any remediation order in the meeting minutes beyond denying the permit at this hearing.
