Hancock County commissioners table fire-department financing question, approve opioid-fund application and multiple personnel actions

The Hancock County Commission on Aug. 14 tabled consideration of a proposed lease-purchase financing for the New Cumberland Volunteer Fire Department and approved an application to receive opioid-settlement funds, along with a series of personnel actions, budget and administrative items.

The commission voted to table a motion to approve a lease-purchase agreement for the New Cumberland Volunteer Fire Department that referenced section 147(f) of the Internal Revenue Code after commissioners asked for legal clarification about whether the transaction would be a private-activity bond requiring additional approvals. The item was resubmitted for research and tabled to the next meeting.

Commission discussion focused on whether the financing would be treated as a private-activity bond under section 147(f) of the Internal Revenue Code of 1986. One commissioner said they had read the code and asked whether the bond treatment applied; county counsel said they had not been asked to research that question and would need to review the statute before offering a legal determination. After a motion to rescind an earlier approval was withdrawn, commissioners moved to table the matter pending further review.

The commission approved the county’s application to receive opioid-settlement funds. Commissioners said the funds are intended to support rehabilitation and related services and that the county will accept applications from organizations that propose appropriate uses. The commission approved a form to be used for those applications.

Other actions approved included: general-fund revision No. 2 for fiscal year 2025–26; advertising for two Parks & Recreation Board vacancies (the board is being expanded consistent with the county code to an 11-member board); multiple personnel items in the sheriff’s office and animal shelter; hiring a full-time 9-1-1 dispatcher; approving an assistant prosecuting attorney hire (name in the record redacted); reopening and scheduling probate matters; and approving general county and levy fund bills. The commission also accepted the resignation of Deputy Caleb Minger and approved payout of his remaining 79 hours of vacation totaling $2,037.41.

The agenda included a memorandum-of-understanding item with Steel Valley Bitcoin LLC, but no motion was made and the commission moved on.

Commissioners set an estate hearing for Oct. 9 at 11:30 a.m. for a probate matter noted in the County Clerk’s Office. The commission also said it will open sealed bids in the commission office after the meeting and reconvened next at its regular meeting Aug. 28 at 2:30 p.m.

Commissioners said the tabling of the fire-department financing was intended to allow counsel to determine whether the transaction triggers section 147(f) review requirements before the commission takes further action.
