The Zoning Board of Appeals approved a use variance on Sept. 10 allowing a single-family residence at 20703 Dexter to continue in a C2 (commercial) zoning district.
Owner and petitioner Corey Petros told the board he purchased the house recently and only discovered during mortgage processing that the lot is zoned C2; lenders told him that without a variance the property could not be rebuilt as a residence if it were destroyed or substantially damaged. Petros said he wanted the variance primarily so he could obtain financing and protect the ability to repair or rebuild the home if necessary.
Board members discussed the property’s history; staff noted the zoning pattern dates to the city’s early records and that several nearby lots are nonconforming residential uses. The board explained that a use variance requires a higher threshold (six yes votes) than many other variances, and secretary staff offered the petitioner the option to reschedule for a full board if he preferred; the petitioner elected to proceed.
Mr. Lindsey moved to grant the variance; Secretary Jersey seconded. The motion passed with the majority of members voting in favor and one member explicitly noting reluctance but voting yes. The board found the continued residential use would not be a detriment to the area and that the property’s nonconforming status was longstanding.
Vote: approved (votes recorded as yes by Mr. Lindsey, Secretary Jersey, Mr. Strowitz, Mr. Sasser, Mr. Cliff [with reluctance], Mr. Green, Mr. Watts and Chairman).
