Revere planning board recommends correcting scrivener errors in ADU ordinance

At a public hearing, a planning staff member read the proposed corrections and explained that the first change would delete erroneous language following the citation to 7.60 CMR 71.02 in section 17.25.03(a) of the Revised Ordinances of the City of Revere. The staff member said the existing text included an extra clause implying that the principal dwelling must comply with off-street parking requirements even when state ADU law allows nonconforming principal dwellings to remain nonconforming.
The staff member read: "There shall be no additional parking required for an ADU in cases where the ADU is located within a half mile radius of an MBTA transit station, as defined in 7.60 CMR 71.02." The correction removes language that could be read to impose additional parking requirements on existing nonconforming principal dwellings.
The second correction fixes a cross-reference error in the ordinance. The amendment replaces an incorrect citation to section 17.05.02(c) with the intended section 17.25.02(c), a typographical error in the originally advertised amendment.
No members of the public spoke for or against the changes during the hearing. Chairperson Ms. Simmons Herlings moved to recommend the corrections to the City Council; Mr. Abrams seconded. The board voted in favor with all present members voting yes and none opposed. The board's roll call earlier in the meeting indicated the following members were present for the vote: Mr. Abrams, Ms. Simmons Herlings (chairperson), Mr. Rivera, Mr. Stamatopoulos and Ms. Hoffman; Mr. Costanza and Garrett Sullivan were absent.
The board recorded the action as a recommendation to the City Council; the City Council will consider the ordinance amendments at a later date. The planning board hearing record did not specify a council hearing date or further council action.
