The Dallas Board of Adjustment, Panel A, voted Tuesday to approve a series of variances and special exceptions affecting residential properties across north Dallas while clearing two uncontested docket items.
Key approvals - Uncontested docket: BOA25-000015 and BOA25-000023 were approved by unanimous panel vote. The items were staff‑recommended and had no public opposition on the record. - 5315 Bonita Ave (BOA25-000022): The board granted a special exception to permit an additional dwelling unit (ADU) “not for rent.” The approval requires the applicant to record a deed restriction preventing the ADU from being used as rental housing. The motion was made by Board Member Kathleen Davis and carried 4–0. - 5917 Belgrade Ave (BOA25-000029): The board approved a 16-foot-6-inch variance to the front-yard setback, an 8-foot fence special exception, and a special exception allowing panels with less than 50% open surface area to be located close to the street. The panel emphasized the fence and setback approvals were tied to a proposed swimming pool and privacy needs and noted that the applicant should pursue a fee-reimbursement request with the board administrator after a city permitting error triggered the hearing. - 5302 Miller Ave (BOA25-000025): A 57-square-foot variance to maximum lot coverage to accommodate a covered patio was granted unanimously. Staff noted the numeric exceedance was minor but that the process was followed correctly. - 11322 E. Ricks Circle (BOA25-000009): The board approved a 6-foot ornamental, mostly open, ornamental fence as a special exception. The panel found the open‑style fence, the substantial setback from the travelway and the presence of other fences and landscape screens in the area meant the fence would not adversely affect neighboring properties.
How the board decided Each approval included the standard condition that the applicant comply with the most recent version of submitted plans. The board repeatedly noted that approvals hinge on the “not adversely affect neighboring properties” standard in the Dallas Development Code; in cases involving fences the panel weighed setback depth, transparency of materials and whether similar barriers already existed nearby. When staff issued or allowed permits in error (a cited instance in the 5917 Belgrade matter), the chair advised affected applicants to ask the board administrator about fee reimbursement.
What this means for residents Homeowners granted variances or special exceptions may proceed with the approved designs after completing any required recording of deed restrictions (ADU) and obtaining standard building‑inspection approvals. The board instructed applicants to meet plan requirements and to coordinate with city inspection staff for permits.
Ending The board closed its Aug. 19 agenda after approving the items listed above and announcing the Champions Club appeal will be rescheduled for Sept. 16 as the first item on that meeting’s agenda.
