DeBary Council approves KBC Luxury Storage rezoning and LDC amendment implementing SB 180; consent agenda passes
Summary

The City of DeBary City Council on Aug. 20 approved second readings for two ordinances and passed a consent agenda.
By unanimous roll-call, council approved second reading of Ordinance 05-2025 to rezone approximately 4.06 acres (Volusia County parcel ID 900900000370) from Heavy Commercial (B-5) to a Business Planned Unit Development (BPUD) designated KBC Luxury Storage. Growth Management Director Stephen Bap told the council the BPUD and development agreement limit permitted uses to an indoor public storage facility for vehicles, boats, recreational vehicles and similar personal property; the project layout shown to council includes 18 storage units, parking, retention and adjacent conservation areas.
Bap told council that attachment A to the development agreement contained two corrections coordinated with variances previously granted: language limiting vehicle servicing to "personally owned motor recreational motor vehicles" and the councils denial of a requested width reduction from 8 to 6 feet. The final development order had been signed by the city manager and staff found the rezoning consistent with the comprehensive plan and with surrounding uses. After a motion and second, the ordinance passed on second reading with the following roll-call votes recorded as "yes": Vice Mayor Butland; Councilmember Sells; Councilmember Papalardo; Councilmember Stevenson; and Mayor Chazet.
Council also approved second reading of Ordinance 06-2025 amending Chapter 1 of the City of DeBary Land Development Code to add Section 1.8, which implements section 28 of chapter 2025-190 of the Laws of Florida (related to Senate Bill 180). Growth Management Director Bap explained the change is intended to ensure the citys code complies with state law enacted June 26, 2025. The new Section 1.8 provides an administrative relief process allowing applicants who believe a post-Aug. 1, 2024 amendment of local land-use regulations is more restrictive or burdensome to request that the previous version of the code be applied to their application; the provision will automatically expire Oct. 1, 2027, or earlier if the state chapter is repealed or substantially amended. With no public comment and no further council questions, the ordinance passed on a unanimous roll call.
The meeting opened with approval of the consent agenda (items 1 and 2) by motion, second and unanimous vote. The city clerk recorded no public participation for either ordinance.
