Scottsbluff council approves preliminary and final plat and variance for Bombgar's Addition; rezoning, annexation advance on first reading

The Scottsbluff City Council on Monday approved a preliminary and final plat and granted a variance required to develop Lot 1, Block 1 of Bombgar's Addition, clearing the way for a new commercial site northeast of an existing store.
City planning staff told the council the planning commission gave a positive recommendation in June and that the proposal includes extending Delta Drive, new curb and gutter, sidewalks, sewer extension and a looped water main to serve the lot. "At the June planning commission meeting, the planning commission made a positive recommendation on this rezone request," city planning staff member Zach said during the hearing.
Council members pressed staff on access, on-site water looping and emergency vehicle turning. Councilmember Stricker asked whether the turnaround easement proposed with the plat provided adequate clearance for fire apparatus and snow plows; Zach said the dashed line on the plat represents a dedicated easement and that public works and the fire department are consulted during the planning process.
The council voted to approve the preliminary plat, final plat and variance with a motion by Councilmember Solomon and a second by Councilmember Phillips. Roll call during the plat vote recorded Solomon: yes; McCarran: yes; Stricker: yes; Phillips: yes; the motion carried and authorized related resolution and contract for public improvements to be signed by the mayor.
Related land-use steps also moved forward on first reading. The council conducted the first reading of an ordinance amending section 25-1-4 of the municipal code to rezone Lot 1, Block 1, Bombgar's Addition (described in the ordinance as an area of about 8.76 acres) from A (agricultural) to C-3 (heavy commercial). City staff also read an ordinance on first reading to annex Lots 1 and 2, Block 1 of Bombgar's Addition and certain adjacent unplatted property and to amend section 25-1-3.1 of the municipal code.
Council and staff clarified financing and access issues. Councilmember Phillips asked whether the developer intended to seek tax-increment financing; staff said the project would "just be their own funds since it's outside a blight area," and therefore would not be eligible for TIF. Councilmembers also asked whether the fire department had reviewed the turnaround arrangement; staff confirmed fire and public works are part of the review for plat submittals.
The plats include a contract for public improvements that will extend a water main from near 20 Fifth Street down to Highland Road and add sewer to Delta Drive. Staff said if a building on Lot 1 requires an on-site water loop under code, that would be addressed at the building or preliminary-plat engineering stage and could be served with a private lateral if appropriate.
With the plat and variance approved and the rezoning and annexation ordinances advanced on first reading, next steps include final engineering and execution of the public-improvements contract. The council did not finalize rezoning or annexation ordinances at final reading during this meeting; those remained at first-reading status.
