Utility board approves $28,000 administrative settlement for Evans Avenue sewer easement

The Evansville City Water and Sewer Utility Board approved an administrative settlement memorandum totaling $28,000 on July 22, 2025, to acquire a needed easement on the Evans Avenue sewer corridor.
Mitch (staff) told the board that during land-acquisition research tied to the Franklin Street project staff discovered the sewer crosses private property without an existing easement. Negotiations with the property owner lasted more than a year. The agreed $28,000 includes the easement purchase and damages to move a generator that sits directly over the sewer main.
Mitch said the cost estimate for moving the generator was about $9,000–$10,000 and that the easement portion was roughly $18,000. He also said the property owner had indicated potential costs could exceed $13,700 plus up to $25,000 in attorney fees if the utility pursued condemnation. In the interest of controlling costs and expediting acquisition, the program management office recommended the settlement as reasonable and in the public interest.
A motion to approve the settlement passed by voice vote with no recorded opposition.
Mitch indicated the owner was asked to relocate the generator either immediately or whenever the utility needs access; staff advised it would be prudent to move it now, he said.
