Port St. Lucie board tables Greenberg variance to Aug. 5; resident raises dispute over fence permit and city enforcement

The Port St. Lucie Planning and Zoning Board on July 1 voted to table variance P25-086, submitted under the name Jared Greenberg, until the board's August 5 meeting.
At the time the board moved to table the item, Jared Greenberg addressed the board during the public "to be heard" segment. Greenberg said he received a citation and a $5,000 lien after placing a rear fence in 2010 on land he said was under jurisdiction of the South Florida Water Management District (SFWMD). Greenberg said he had a SFWMD permit to place the fence and that the city later rescinded a city permit he had been given. "I got cited by code enforcement for my rear fence not being on my property even though I have permission from South Florida Water's arrangement for that fence to be placed there and it has been placed since 2010," Greenberg said, adding that SFWMD representatives told him he could keep the fence.
The city attorney noted that Greenberg's remarks during the public comment period were not under oath and should not be taken as evidence in the quasi-judicial proceeding, and staff indicated the variance matter is scheduled for the August 5 meeting. The board chair told Greenberg staff would take up the issue and follow up with him within a week to 10 days and that staff had his contact information on file.
Board members moved and seconded a motion to table P25-086 to the August 5 Planning and Zoning Board meeting; the motion carried on the record.
The matter as described by Greenberg raises a potential conflict between permits or approvals from the South Florida Water Management District and city code enforcement actions; staff indicated they will review the situation and respond to the speaker by phone or email.
