The Nevada Commission on Ethics approved a stipulated agreement resolving complaint 20Four-109C concerning Charles Green, secretary‑treasurer of the Board of Homeopathic Medical Examiners. The commission voted to formalize the settlement after a presentation by executive director Russell Armstrong and the parties’ counsel.
The complaint, initiated by the commission on its own motion, alleged that Green did not appropriately disclose or abstain during a board meeting in which the board considered compensating him for services. Under the proposed agreement, the commission found a single non‑willful violation of NRS 281A.420(1) (the disclosure requirement). The terms require Green to pay a $500 monetary penalty, with $250 suspended; to provide the board requested information and materials to assist its work; to step down from the board; and to complete ethics training if he returns to public service. The agreement also provides for a formal admonishment by the commission.
Executive director Russell Armstrong told commissioners the board’s enabling statute expressly allows payment to a secretary‑treasurer for services, and that the settlement reflects that statutory context along with other case factors. Armstrong also noted the Department of Business and Industry was handling related matters.
Vice Chair Wallen and Commissioner Lowery were precluded from participating in the matter under NRS 281A.220(4) because they served on the review panel and therefore abstained from the final vote. Commissioners present approved the stipulated agreement; the motion carried with five affirmative votes and two abstentions.
The commission directed counsel to formalize the agreement in the appropriate legal form and entered the stipulated agreement into the record.
