Drainage district authorizes manager to sign utility permits, approves Rainbow Drain grant reimbursement and multiple construction actions

The Hidalgo County Drainage District Board of Directors voted to give the district general manager authority to sign utility permits and approved multiple construction contracts, payments and land-use agreements tied to the district's 2023 drainage bond program.
The board approved a resolution granting the general manager authority to execute utility permits “in accordance section 49,056 a and 49,057 gs,” a procedural step the general manager said will make permit processing more efficient. The board voted “aye” and the motion carried. The action was described as mirroring existing staff authority for discharge permits.
The board also approved a resolution and affidavit requesting reimbursement from the Texas Water Development Board in the amount of $500,000 for the Rainbow Drain project; the general manager said the funds will be reimbursed after the district documents prior investments. The motion carried. Separately, the court approved a payment of $68,675 to the U.S. Army Corps of Engineers for coordination work related to the Rainbow Drain Project, section 203; that payment was approved by motion and carried.
Board members approved several land- and use-agreements and interlocal permit applications needed to clear property and proceed to construction on specific bond projects. Those approvals included authorization for the chairman to execute documents for a property-use agreement with Miguel A. Chavez for the E 22029 J 01 drain project and approval of Hidalgo County Irrigation District No. 2 permit application relating to the Alamance Restway drainage project.
The board accepted construction bids and approved payment applications for multiple projects funded in the 2018 and 2023 bond programs. As part of those items the board: accepted a sole bid recommendation and authorized award of a construction contract as recommended by the project engineer; approved multiple contractor pay applications and change orders; and authorized the general manager to approve change orders up to $50,000 in accordance with the referenced Texas Water Code provision. On one contract change order (Farm Account Ladder East project, 2023 bond, contract CACDD1240290611), Commissioner Villareal abstained from action; the motion otherwise carried.
Board staff said many of the approvals are part of moving engineered projects into construction phases and that right-of-way and easement work for projects such as the Mayberry Road to Kalloskuk Road drainage range improvements are underway. The manager noted the district remains in hurricane-season readiness while continuing active construction.
No new policy changes were adopted; actions were limited to authorizing permits, accepting bids, approving payments and executing routine interlocal and property documents necessary to advance projects. The Drainage District recessed to and returned from a closed session during the agenda and later adjourned to allow participation in the County Commissioners Court meeting.
The board did not provide additional fiscal detail for every line item at the time of vote; amounts that were unclear in the meeting record were marked in minutes as not specified pending final contract documents and legal review.
