The Missouri City Council unanimously approved a resolution July 21 waiving a $700 fee for a homeowner who rebuilt a storm‑damaged fence that became nonconforming under zoning rules.
City staff said the repaired fence delineates a homeowner's driveway from a public golf‑cart path and that the rebuilt portion slightly extended past the previous building line. The council heard from homeowner Daniel Perez, who said he rebuilt the fence using similar materials and bracing after storm damage and had not intended to create a nonconforming structure. "I was just simply doing a partial rebuild of what was already there using the same materials," Perez told the council.
Staff recommended the fee waiver on public‑safety grounds because the fence reduces the risk of cart or pedestrian traffic crossing into the driveway area. Council Member Emery moved to waive the zoning‑board fee; the motion was seconded by Council Member Clauser and carried unanimously.
