Staff emphasized the amendment does not alter other MOU conditions: fire protection and infrastructure conditions remain in force, no certificates of occupancy (COs) will be issued until the parkway opens and the developer remains responsible for required infrastructure.
Planning staff said the approved approach will be implemented as a concise addendum rather than a wholesale restatement of the 2024 MOU. The addendum authorizes 12 additional permits, restates that public access to unfinished parkway areas remains prohibited, and preserves all other commitments in the original MOU. Council members noted the developer still must comply with fireflow and other requirements; staff confirmed fire protection will be expanded as soon as the water tank permit is in hand.
