Council rezones 800 Holman Way to "tourist commercial" and approves conditional use permit for existing gaming use amid neighborhood concerns

The Sparks City Council voted unanimously July 14 to change the comprehensive plan designation and rezone a 5.99-acre site at 800 Holman Way from Commercial (C) to Tourist Commercial (TC), and to approve a conditional use permit to recognize a currently operating nonrestricted gaming establishment as a conforming use.
Sienna Reed, planning manager, told the council the site contains four buildings including Scolari's grocery and a nonrestricted gaming operation that had grown to 7,891 square feet through prior approvals. Reed said the proposed TC designation supports tourist-oriented activities, including unrestricted gaming, and noted the city has five TC-designated locations that are generally adjacent to major arterials.
Planning staff found that the change is consistent with the comprehensive plan's goals for land-use diversity and economic vitality, that parking is sufficient (site requires 179 spaces and provides 284), and that no expansion of the gaming floor is proposed. The staff report and the planning commission recommended approval.
During the public hearing, Ward 2 resident Hunter Rand spoke in opposition, urging council to preserve the existing nonconforming status so future purchasers would not automatically be able to intensify the site. Rand raised concerns about neighborhood compatibility, traffic on Pyramid Way, safety and the lack of public support for rezoning in the record. Reed noted a neighborhood meeting was held (10 attendees) and that four written comments opposing the project were received before the planning commission.
Councilmember Diane Vanderwell, citing planning experience and lending background, moved to certify the comprehensive plan amendment; subsequent motions rezoned the site and approved the conditional use permit. All three votes carried unanimously.
The conditional use permit (CU252-0003) was approved subject to the three conditions listed in the staff report; no expansion of the gaming establishment was authorized. Reed said that any future change to the CUP would require a formal amendment application, mailed notice to properties within 500 feet and a planning review; a neighborhood meeting would be required only if council imposed that condition.
