Council grants conditional-use permit for sand and gravel extraction east of Cherry Avenue

The Kearney City Council voted to grant a conditional-use permit for a resource extraction operation east of Cherry Avenue and south of East Eleventh Street by adopting Ordinance 87-53.
Applicant Roger Harders described the proposed operation and mitigation measures at the public hearing. He said the plan is to retain and reuse topsoil to build berms and plant a vegetative buffer; he told council members he had no plans to sell topsoil and intended to use it for on-site screening. Harders said he would raise portions of the site to move some work out of the mapped 500-year flood plain.
Harders and staff discussed permit conditions covering stockpiling, buffers and a 15-year operational period. City staff clarified that materials could be stockpiled on site up to 35 feet in height and must be set back 50 feet from the top of the slide/edge; Harders said he expected gravel sales to move stockpiles down quickly. He also told council members the plan includes planting cotoneaster bushes along the east side as a visual buffer.
The council adopted and passed Ordinance 87-53 on roll call. The hearing record shows council members (Mayor Nicola, Schmidt, Stratman, Bush Cutter and Ward, among others) voting in favor; the ordinance was then placed on final passage and approved as provided by law.
Harders did not present a detailed annual production estimate at the hearing. City staff and the applicant indicated ongoing oversight and permit compliance requirements would apply during the operation period.
