Council weighs Buy America waiver to accept lower bid for community‑center lighting retrofit

Bluff Town Councilors reviewed bids on July 8 for an energy‑efficiency lighting retrofit at the Bluff Community Center and discussed whether to pursue a Buy America/Build America waiver so the council could accept the lowest priced bid.

Town staff reported three bidders submitted proposals: two that complied with Buy America/Build America requirements and one that did not. The noncompliant bid—Lyle Electric—was substantially lower (around $23,784.04 in the submitted noncompliant quote), while the lowest compliant bid from Ultralight was $41,897.10. The town’s Energy Efficiency and Conservation Block Grant (EECBG) will cover roughly $26,500 in fixture costs, leaving the town responsible for the remainder if a compliant bid is accepted.

Staff said they had begun preparing a waiver request to the Department of Energy; the waiver process could take several months. The project officer told staff she is often able to work with grantees to extend project deadlines if waiver processing pushes the timeline out.

Councilors expressed a preference to pursue the waiver rather than pay substantially more for compliant fixtures, noting there is no immediate emergency requiring the lights be replaced this summer. Council direction was to continue pursuing the waiver, to obtain written expiration or timeline confirmations from bidders, and to bring the item back at the next meeting (moved to the July 15 meeting) with the non‑Buy America quotes and staff recommendation so the council could select a bidder without leaving vendors in limbo.

Staff also noted procurement considerations: Davis‑Bacon wage determinations included with bids are valid for 90 days and could affect final costs if the contract is delayed. Staff will obtain written confirmation from each bidder about quote validity and timeline before the next council vote.
