The continuance request, made by the applicant, followed more than two hours of public comment and technical questions from commissioners. The applicant's attorney, Tanesa Azar of Moses Ryan, told the commission the developer had scheduled an evening site visit for July 17 at 5:30 p.m., planned to start at a neighborhood gathering point and then proceed to the property, and said the team would deliver additional survey information on rights-of-way prior to the August meeting. "We've used the time since the last meeting to work on scheduling a site visit to the property," Azar said, and that the applicant had filed a written response memo the same day.
The hearing produced sustained opposition from neighbors and a private attorney representing several abutters, who said the applicant had not met its burden to prove lawful access to the property and raised multiple technical and environmental concerns. "They cannot satisfy their burden of proof to show that they have access to this property," said Steven Sleipold, attorney for several neighbors.
