Pompano Beach board recommends abandoning cross-access easement at 1 N. Andrews Ave., subject to FDOT sign-off

The Pompano Beach Planning & Zoning Board on Wednesday recommended the City Commission approve an application to abandon a 30-foot cross-access easement at 1 North Andrews Avenue (file PZ25-27501), but only after the applicant obtains a letter of no objection from the Florida Department of Transportation (FDOT).
Development Services planner Maggie Barshevsky told the board the easement runs on the west side of the Wawa site roughly 340 feet west of the northwest corner of Atlantic Boulevard and Andrews Avenue. Barshevsky said the easement was originally intended to allow adjacent parcels to share vehicular access across the Wawa property, but the industrial development to the west will construct a shared access drive and Wawa’s access will shift about 40 feet to the west. Staff concluded the abandonment meets the code review standards and recommended approval to the City Commission with a condition: the applicant must submit a FDOT letter of no objection prior to the Commission hearing.
Board member Carla Coleman moved that the board “finds that competent and substantial evidence has been presented” and recommend approval to the City Commission subject to staff’s condition; a second was recorded, the applicant agreed on the record to the condition, and the board voted unanimously in favor.
The applicant, Aaron Kosh (address given on the record), confirmed his client accepts the staff condition. Bobby (board secretary) conducted the roll call; recorded yes votes were Carla Coleman, Rich Dally, Gigi DeBeck, Paul Fisher, Robert Hartsell, Tundra King and Fred Stacer.
Because the board’s action is a recommendation to the City Commission, final approval will come at a subsequent Commission hearing after the applicant furnishes the FDOT letter of no objection.
