Pompano Beach planning board puts three Palmyra-area applications on hold amid litigation

The Pompano Beach Planning & Zoning Board on Wednesday voted unanimously to stay consideration of three agenda items related to the Oaks at Palmeir development while pending litigation is resolved.
The board acted after the city attorney told members that Paul Mayer Country Club Condo Association No. 8 and two individuals filed a class action in November 2024 challenging the city’s allocation of flex units and other actions. The attorney said an amended complaint filed in late May added parties and that “because of the implications of the litigation ... the city attorney’s office recommends that review of the following applications of tonight’s agenda be stayed pending the resolution including appeal of the litigation”: item 3 (flex allocation), item 4 (major site plan), and item 5 (plat application).
Board members discussed and then voted separately to stay each item “until such time as the lawsuits and the appeals are completed,” removing the matters from the board’s agenda while litigation is active. The board’s roll calls show all members present voted yes on each stay.
The stays mean the three items will not be scheduled for Planning & Zoning review until the litigation and any appeals conclude and any applicable appeal period has expired. The city attorney clarified after the votes that the stay temporarily removes the matters from the board’s docket and that proper public notice will be given if and when matters return to the board.
Bobby (board secretary) conducted roll calls for each stay; board members recorded as voting yes in each roll call were Rich Dally, Tundra King, Gigi DeBeck, Paul Fisher, Robert Hartsell, Carla Coleman and Fred Stacer. No board member voted no on any of the three stay motions.
The city attorney’s statement, and the board’s votes to stay the three items, were recorded on the meeting transcript and will be reflected in the administrative record when the matters are returned to the board or proceed to other hearings.
The stays do not decide the underlying land-use or plat applications; they pause local review pending a court outcome and any appeals.
